Optimum Foods owners, employees, departments, agents and agencies cannot be held responsible for any losses, damages, expenses, claims, demands, suits, or actions of any kind including reasonable legal fees made by any third party due to or arising from your use of this site, information obtained from the site, information which you provided to the site, your connection to the site, your violation of these terms and conditions, or your violation of any rights of another. Your Personal Data Any data entered into our website is only used for the purposes of your order. We do not collect your information for marketing purposes and will never share your details with any other company. Our payment system uses a secure web server. You can check the server certificate by clicking on the padlock in the bottom bar of your browser. Any information is stored and sent using encryption making your order as secure as possible. The Right To Cancel When you have placed an order with us, you are able to cancel the order with no charge until the order is despatched by us. You agree that we cannot be held responsible for any damage that might be caused to any goods by temperature or any other climate related conditions during transit. Any goods which are proven to be faulty or have been incorrectly despatched may be returned to us within 7-days of receiving them. Non-perishable goods which are not faulty may be returned to us within 7-days of receiving them. The recipient agrees that they will be responsible for ensuring that any returned goods are received by us without damage, un-opened and in a condition that allows the goods to be resold at the full price. Please note that for our perishable goods the 7-day cooling off period from the "Consumer Protection (Distance Selling) Regulations 2000" does not apply. We are unable to accept returns for perishable good unless proven faulty. In the event that we receive any returned goods in a state that is not identical to the state in which the recipient originally received them, we reserve the right to issue no or only a partial refund for the goods. In the unlikely event of your delivery arriving damaged or faulty, please use the links on the contact page to notify us. You must do this within 7 days of receiving the faulty goods. The customer agrees that they will be responsible for all costs incurred when returning any goods to us for any reason unless we agree otherwise. The recipient also agrees that they will ensure that we receive any returned goods. We recommend that a recorded and insured postal service is used for any returns. Please remember that you must keep proof of posting for all returns. Refunds, the customer agrees that unless we agree otherwise the maximum amount of any refund will be limited to the price paid for any returned goods and will not include any additional costs whether incidental or otherwise including but not limited to any postage and packaging costs. Out of stock items, if any item you have chosen is unavailable, we will contact you via phone or your email address and set out the options that are available to you. Return of goods policy, we want you to be completely satisfied with your purchases. Please let us know if you are not entirely satisfied with our products or our service. Items are described and photographed as accurately as possible, but please note that sizes, colours and designs may vary. If you are not completely satisfied with any item you ordered, just return it, if possible in the original packaging (with your customer advice note) within 14 days of the date of receipt and we will refund your money or send you a replacement. Items returned under our14 days returns policy must be unopened with any seals packaging and shrink-wrap intact. Please note: we can only accept the return of opened items if they are faulty. We are only able to replace with identical products, so if you wish to order additional items it will be treated as a new order. Our guarantee is in addition to your statutory rights. When you send your item back to us, we'll process the returned item then notify you via e-mail of your refund. You can expect a refund in the same form of payment originally used for purchase within three weeks of our receiving your return. If you are returning an item because of an error on our part or because it is damaged or defective, we will be happy to refund the delivery charges incurred in sending the item to you and we'll reimburse your reasonable costs in returning it to us. Cancellation Policy - Please note that you have a legal right to cancel your order within 7 days of the date of receipt of the goods (provided the goods are returned to us new and in an unused condition in the original packaging together with the original packing advice note) and by returning securely packaged to Optimum Foods.co.uk 102 Gladstone Street Swindon Wiltshire SN1 2AX, a refund will be provided within 30 days of the date of cancellation. Minimum Order Value, a minimum order value of £40 excluding delivery charge is a condition of using our service, unless otherwise agreed. Shipment UK delivery is normally via DHL courier service. Goods supplied subject to stock availability. For delivery service information to any of the following or overseas destinations, Channle Islands, Isle of Man, Shetland Islands, Outer Hebrides, Orkney Islands, Western Isles, Isle of Eigg,Brodick & Millport, Isles of Scilly and British Forces Post Office. A flat rate of £7.95 will be charged on all orders. The postal area is UK mainland post codes only, others and world wide by arrangement. Please be aware that the postal services that we use may require a signature when the goods are received. Postage Times, any postage times stated are given purely as an estimated guide only. The actual postage times may vary greatly from those stated either verbally or in writing or by any other method. Product Weights, it should be noted that as with most other packed foods, the weights of all the products are approximate. Product Images, product images are for display purposes only. The actual product may sometimes vary slightly in appearance. Product Substitutions, we reserve the right to substitute any items in an order with an alternative that is similar to the original product. Product Categories and Descriptions For ease of use the products on our site may be sorted into categories. Some or all of these categories and product descriptions may relate to dietary requirements or food allergies. Although we try to ensure that the products listed on the site appear within the correct categories and have the correct descriptions this cannot be guaranteed and mistakes may be made. For this reason, you must ALWAYS careful check any products that you receive before they are used. This is particularly important if you have any allergies, intolerances, religious or moral beliefs that may restrict your use or consumption of any products. If you are still unsure after examining the product, do NOT use them until you have obtained professional advice from the manufacturer or an alternate source where possible. Product descriptions are for general information purposes only. The actual product may sometimes vary slightly from the description given. If you do purchase any products, which you cannot use because they may appear in the wrong category or were given an incorrect description, please contact us in order to discuss the possibility of a refund. Charges, we will confirm acceptance of your order in writing, by a message on the website, an email or both. If an item you order is unavailable, we will contact you as soon as possible to make alternative arrangements. We are not liable for any technical errors and will contact you as soon as possible to resolve any problems. Vouchers, Promotions and Special Offers We may from time to time offer promotional prices and special offers. If you are a lucky recipient of an offer, the validity will be clearly stated to you either on the website, or on the voucher. In the event of any problems with a voucher or promotion, please use the contact page to let us know. Complaints Procedure Any complaint will be acknowledged within 5 working days, and will be resolved to mutual satisfaction within 15 working days. During the interim the customer will be informed of the progress. In the first instance contact Paul Horrobin at, paul@optimumfoods.co.uk, and he personally will endeavour to resolve the problem. If the complaint is due to our carriers, we will resolve it with you the customer first, and settle the issue with our carriers later. Any comments at all on our products or service will be taken very seriously as we strive to become the most reliable on-line supplier of specialist, organic food and drink. Likewise any products that you would like to see featured, then please do let us know. Small print whilst every effort and care has been taken to ensure that this information is correct, products are constantly being improved and ingredients lists altered. We therefore recommend that you do not rely solely on the information presented here but you must always read the label before consuming the product.
